Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in its entirety. In such jurisdictions, Pizza Luce's liability will be limited to the greatest extent permitted by applicable law.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting Pizza Luce at [email protected] and providing a written description of your complaint, the relief you are seeking, and your contact information. Pizza Luce will attempt to resolve the dispute within thirty (30) days of receiving your written notice. If the dispute is not resolved within thirty (30) days, either party may proceed to the dispute resolution methods set forth below.

10.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Subject to the exceptions set forth herein, you and Pizza Luce agree that any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be resolved by binding arbitration conducted by a recognized arbitration organization such as the American Arbitration Association (AAA), in accordance with its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be conducted in English and take place in the United States.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Agreement, including any claim that all or any part of this Agreement is void or voidable. The arbitrator's award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

10.3 Class Action Waiver

YOU AND PIZZA LUCE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Pizza Luce agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims, and may not otherwise preside over any form of a consolidated, representative, or class proceeding.

10.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may bring an individual action in small claims court. Pizza Luce may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights.

10.5 Opt-Out Right

You have the right to opt out of binding arbitration within thirty (30) days of the date you first accepted these Terms by sending a written notice to [email protected] stating your full name and that you are opting out of arbitration. If you opt out of arbitration, all disputes shall be resolved in accordance with Section 9 (Governing Law and Jurisdiction).

11. Term and Termination
